论环境法律制度的社会法属性——以环境利益为视角

On Social Law Attribute of Environmental Law System from the Perspective of Environmental Interests

社会法学者普遍将环境法律制度纳入社会法的范畴,但少有对之展开专门分析者。文章基于社会法学界有关社会法属性的现有研究成果,以环境利益为视角,剖析了以保障环境利益为其本质追求的环境法律制度具有确保人类正常生存繁衍及可持续发展的功能属性、追求环境正义的价值属性、"一体两翼一支撑"的机制属性以及促进人与自然和谐共生的目的属性,此均与社会法的本质属性相契合。正视环境法律制度的社会法属性并以之作为构建环境法律制度的基础是解决我国现行环境法律实效不彰之困境的重要途径。同时,探究社会法属性在环境法律制度中的体现,有利于深化对社会法根本性问题的认识,扩展并夯实社会法学的研究领域。

Though social law scholars generally set environmental law system m the category of social law, few specific research has been undertaken on this area. Based on the existing literatures of social law attributes,this paper focuses on analyzing the attributes of environmental law systemin from the perspective of environmental interests, which includes the functional attribute of ensuring the normal human survival and sustainable development, the value attribute of pursuing environment justice, and the mechanistic attribute of ＂ one body-two wings-one suppor＂, as well as the aim attribute of promoting harmonious coexistence between man and nature. All these attributes are corresponding to the essence of social law. Furthermore ,envisaging the social law attributes of environmental law system and serving it as the basis of constructing environmental law system are important ways to solve the implementation dilemma of current environmental law in our country. At the same time, exploring the social law of environmental system is beneficial for deep understanding of the fundamental issues of social law and broadening the research areas of social law.
