The Effect and Approach of Reform of Administrative Reconsideration:Report on Field Study of Administrative Reconsideration

行政复议改革进行的八年间,各省市在地方实际情况的基础上,在复议委员会的建立、管辖权的集中与程序的创新上形成了不同内涵、各具特色的制度内容。改革面临的主要问题在于行政复议的组织、管辖、程序三个方面。据此,行政复议制度的进一步改革应从重塑行政复议组织机构、集中复议管辖权、改革案件审理程序三个方面着力。

During the past eight years of reform of administrative reconsideration, based on local experiences, local governments have improved the system with designs of different kinds. These include establishment of committee of administrative reconsideration, centralization on jurisdiction, and innovation on review procedure. The main problems of reform are the organization, jurisdiction, and procedure of administrative reconsideration. Thus, the further reform should focus on reshaping the organization of administrative reconsideration, centralizing jurisdiction, and improving review procedure.
