德国行政程序法法典化的发展

Development of codification of German Administrative Procedure Law

德国行政法的发展过程中,受到早期重实体轻程序思想的影响,使得一般行政程序法的法典化进程直到20世纪70年代才逐渐得以实现。在随后40多年的实施过程中,为了和不断发展变化的行政活动相适应,法典化的行政程序法虽然也经历了一系列的修改,但是关于法典化改革的呼声却从未间断。尤其是在经济、社会以及科技高速发展的今天,如何有效应对信息行政、电子化行政以及多元化行政活动形式带来的挑战;如何在欧洲一体化进程中协调本国行政程序法与欧盟法之间的关系;如何在权利救济方面更好地将行政复议程序与行政诉讼衔接起来,成为德国行政程序法典化发展中必须要解决的问题。

During the development of German administrative law, affected by early thought of heavy entity light procedure, the codification process of general administrative procedure law was gradually realized until 1970 s. In its following 40 years＇ implementation process, although the codified administrative procedure law endured a series of modification in order to adapt to evolving administrative activities, the calls on codification reform has never stopped. Especially nowadays with high-speed development of economics, society and technology, the German administrative procedure law codification development needs to solve many issues, eg., the challenge brought by informatization administration, e-administration and diversified administrative activity forms, relationship coordination between the national administrative procedure law and the EU law in the European integration process, the licking up of administrative reconsideration and administrative litigation procedures in aspect of right relief.
