当前,我国在处理医疗纠纷案件中,由于过于的强调患者及其家属权益的保护,从而忽略了对医方合法权益的保护,甚至导致暴力伤医事件屡屡发生。文章通过剖析我国医疗纠纷案件中医方合法权益遭受的程度与原因,从医院加强风险管理,完善暴力伤医相关刑事立法等方面提出合理保护医方合法权益的具体措施。

At present, people excessively emphasis on the protection of rights and interests of patients and their families in dealing with medical disputes cases, and ignore the protection of the legitimate rights and interests for doctors, resulting in injury medical events occur frequently. This paper, in view of the cause and level of legitimate rights and interests of doctors suffered in medical disputer,provided the specific measures of strengthening risk management and completing legislation.
