随着全球化的不断深入推进,国家间法律文化的交流互动也日益活跃。以"权利—义务—责任"建构法律文化概念可以理顺文化交流的基本思路。其中法律文化交流的主要动因包括文化现象自身的"文化差—文化压"和法学范畴中的政治因素、历史因素和社会因素。当代中美法律文化交流则呈现出由纯粹学术交流过渡到基于法律制度的实践探索、由官方法律文化交流过渡到各类形式并存的格局、由教师主导过渡到教师参与下以学生为主体的交流形式和由关注历史传统过渡到关注历史—现代相结合的交流视角之新转向。
