住宅土地使用权到期后续期之立法完善——温州事件引发的法律思考

Legislation improvement of renewal of residential land use rights after expiration—Legal thinking raised by Wenzhou event

土地使用权到期续费问题,引发的关注度极高。盖因其关乎千家万户的重大利益,立法的一个留白,引发了全民的不安。本文结合温州事件所涉及的法律问题阐释了住宅土地使用权的权利属性,现有立法缺失的成因,续期收费的不正当性分析,进而从立法角度,通过完善现行物权法之相关规定,提出了明确具体的解决思路,期望对未来《物权法》的修改有所裨益。

Renewal problem after expiration of land use rights has caused a heat attention for the vital interest of millions of households, and triggered an overwhelming anxiety with blank legislation. This paper, combines with the legal issues in Wenzhou event, illustrates the property of residential land use rights, the reason for the lack of existing legislation and the analysis of the fraud renewal fee, before the legislative viewpoints by improving the relevant provisions of the existing property law, by proposing explicit and specific solutions to benefiting the modification of ＂Property Law＂ .
