实习生因工受伤事故责任认定的现状与对策

Status and Countermeasures of Responsibility Cognizance for the Injury of Trainee on Duty

当前高校大学生实习制度中存在的管理和立法漏洞导致无法切实保障实习生的人身权益。实习生身份认定的不确定性以及当前对实习生因工受伤制度的立法空白是造成实习生人身权益救济不足的重要原因。完善三方协议制度,全面推行实习责任保险,进一步完善相关立法是改变现状的重要途径。

Practice system is an important way to realize higher vocational education, which is the vital part of the college study. Management and Legislative loopholes existing in the current internship system can not effectively protect the personal interests of interns. Uncertainty of identity of the trainee and the legislative blank of the system of trainee labor injury cause the deficiency of the relief of the personal rights and interests of the trainee. So perfecting the system of three party agreement, full implementation of practice liability insurance, and further improving relevant legislation are proposed to improve the current status.
