土地产权是影响农民生产行为的重要制度因素。近年来,农村土地拆迁在本质上都是城乡统筹条件下而进行的土地发展权转移行为,这与我国制度背景有很大关系,因此,在转移土地发展权过程中容易发生地方政府与农民争利的情况。从目前农村经济以及市场经济发展之需要来看,必须创新农村土地产权制度,进一步明晰产权归属,完善农村土地流转机制。
