技术人工物结构与功能的多样性,致使潜在的"使用发明"问题出场。"使用发明"是技术人工物的结构或功能在使用领域中的扩大、转换或他用,是技术发明进程中的重要组成部分,它包括"转用发明"和"用途发明"等发明形式。"使用发明"与技术人工物的结构、功能和人的意向性直接关联在一起,"转用发明"是技术人工物结构的他用,而"用途发明"是技术人工物功能的他用。从发明的逻辑看,"使用发明"既是技术发明本身的延续,又是一类技术发明演化的新图景。
The diversity of the structure and function of the technical artifact has made the potential issue of inven- tion in the practical use prominent. Invention in the practical use is the expansion, transformation or use of the structure or function of the technical artifact for other purposes. It is an important part in the process of technical invention, which includes such types as ＂invention by diversion＂ and ＂for-ness invention＂. Invention in the practi- cal use is directly connected with the structure and function of the technical artifact and human intentionality. ＂In- vention by diversion＂ means the structure of the technical artifact is used for other purposes. ＂For-ness invention＂ means its function is employed for other purposes. From the logic of technical invention, invention in the practical use is not only a continuation of technical invention itself, but also a new picture of the evolution of technical inven- tion.
