摘要
农村土地经营权必须在物权法和债权法的制度框架下进行研究和探讨。土地经营权本质属于债权,但它同时具备进行物权保护的现实需求。土地经营权应以用益物权进行规制,颁发土地经营权证书,以便农村土地有序流转。法律对土地经营权进行规制已迫在眉睫,建议对《物权法》《土地管理法》和《农村土地承包法》中关于土地承包经营权条文做出相应修改,同时将土地经营权纳入未来不动产立法的范围,并落实与完善土地承包经营权与土地经营权颁证工作。
Rural land management rights must be studied and discussed in the institutional framework of real right and obligatory right. Land management rights belong to the nature of obligatory right, but it al- so has increased the demand for real right. Land management rights should be regulated by usufructuary right and issue land use rights certificate to facilitate an orderly transfer of rural land. So it is imminent to regulate land management rights by law. It is recommended to revise the land management rights provi- sions in Property Law, Land Management Law and Rural Land Contract Law, include land management rights in the scope of the future real estate legislation and implement and improve the certification work of land contract management rights and land management rights.
