摘要
通过考证中超联赛的历史沿革、经营机制、赛事特征及其法律属性,剖析了中超联赛赛事表演服务"产品说"与"作品说"的法理缺陷及其对中超联赛法律保护的不利影响,从《著作权法》视角界定中超联赛属于一种商品性表演服务活动。基于以上认识,进一步阐释中超联赛表演服务活动的价值及其市场供方主体权益,在市场供应主体中:国际足协理事会、中国足球协会分别享有中超联赛作品表演权,而中超联赛俱乐部、中超联赛运动员拥有中超联赛表演者权,中超公司拥有服务经营权,由此从法理上厘清中超联赛的各种收益归属。
By examining the history, operational mechanism, event features and its legal attributes, analyzes the legal principle limitations of "Product Theory" and "Work Theory" of Chinese Super League (CSL) and the unfavorable impact these two theories have brought on the legal protection of CSL. From the perspective of Copyright Act it then defines CSL as a kind of commercial performance service. It further expounds the value of its performance service and subject rights of the supply parties. Among the suppliers, International Football Association Board (IFAB) and Chinese Football Association (CFA) share the performance right d the works, while CSL Club and athletes d CSL own performer right, CSL Stock Corporation has its service operation right. Hence, different income distributions from CSL are clarified from a legal perspective.
