摘要
《吕氏乡约》应溯源至南方少数民族的"款"。《吕氏乡约》是因应土地私有和人口流动、宗族重整、乡村"官治"不足、政治改革无力等多问题的理学探索和设计。乡约的自治性质和教化功能,是有限的自治性和实质的他治性之间充满张力的结合。乡约的效力应从国家的、伦理的、事实的和心理的维度加以实证研究,以确证乡约的制度性而非观念性事实存在。
Lv'Community Covenant was a probing Confucian design to cope with privatization of land,mobility of population,reconstruction of clan,insufficient local administration,weakness of political reform and so forth,which should traced back to Kuan of south ethnic group. Community covenants with autonomous nature and moral education fuction,was a kind of joint which was full of tension between limited autonomy and substantive coercion.Community covenants' force should be researched by a positivist approach from state,moral,factual and mental aspects,to prove its not ideal existent but institutional existent.
