论我国互联网金融投资者准入法律制度

On China's Legal System of Internet Financial Investors Access

随着互联网金融的发展,监管者对互联网金融的投资者准入的制度安排在很大程度上是对传统金融监管的复制,即将投资者按一定的能力标准进行分类,提供差异化的市场、产品和服务,并严格监管。但事实上在网络经济时代,监管者基于传统技术和金融模式所确立的监管规则与法律规制,已经不适应互联网金融的新特征。构建开放条件下的互联网金融监管体系,以及新的信息披露制度、投资者顾问制度和投资者教育制度非常必要。

With the development of the internet finance,investors access to the internet finance regulation arrangement is copy on the traditional financial regulation in a large extent. It is certain standards of classification according to the ability of the investors,it provides differentiated market,products and services,and strict supervision. But in fact,in the era of network economy,regulators based on traditional technology and financial model are established by the regulatory rules and legal regulation,have not been adapted to the new characteristics of internet finance. We should build the internet finance regulatory system,and build a new information disclosure system,investors advisory system and investor education system implementation.
