On the Role of Judicial Assistant

对司法助理员的角色定位缺乏客观、清晰的认识与分析是造成司法所地位不显、功能不彰的根本原因。立足于复杂多样的基层司法实践,司法助理员注定要担负着多重角色,既是政治人,又是法律人,既是政府管理者,又是权益保障者。这些角色之间彼此互相联系又互相对立,一旦处理不当,则产生剧烈的冲突,从而陷入角色困境之中。加强司法助理员的角色建设,一方面依赖于制度层面的完善,另一方面则依赖于司法助理员个体人格的健全、素质的提升。

Lacking of objective and clear analysis of the role orientation of judicial assistant is the primary cause. The expectation for judicial assistant is mainly from administrative system, juridical organization and public. Established in complex judicial practice of the basic level, a judicial assistant who is both a political man and a legal personality, both a government regulator and a rights protector, definitely undertakes multiple roles. These roles are interdependent and contradictory. Once mishandled, it will conflict violently and thus fall into role dilemma. Enhancing the role development of judicial assistant lies in the perfection of the system and the sane personality and quality improvement of judicial assistant.
