论非婚生子女抚养权的法律保障问题

目前,我国婚姻法承认非婚生子女与婚生子女享有平等的抚养权,但是在现实司法实践中仍存在非婚生子女亲子关系确定的证明责任不利风险、抚养权之诉缺乏权利救济、抚养费强制执行难等问题。为了有效保障非婚生子女的抚养权,因此针对上述问题我们必须完善非婚生子女抚养权的法律保障制度,以期实现我国非婚生子女健康快乐的成长与良性发展。

At present, the marriage law of China admits illegitimate children and children born in wedlock enjoy the equal custody. But in the actual judicial practice, there are problems that illegitimate children bear the burden of proof in the risk of adverse, and are lack of right relief and alimony enforcement. In order to effectively protect the custody of illegitimate children, we must strongly support the illegitimate child and improve the child care legal protection system. It will make China＇s illegitimate children grow happily and healthily, and could get the healthy development.
