摘要
农村集体建设用地市场化是发展社会主义市场经济的内在需要。中国农村集体建设用地市场化从20世纪90年代末以来,先后经历酝酿、尝试和启动三个阶段。随着经济社会的进一步发展,突破现有法律法规限制、制度体制障碍,推进农村集体建设用地市场化已经成为客观需要和现实选择。在转型时期,实现农村集体建设用地市场化需要共同发挥市场的资源配置作用和政府的宏观调控职能,以完善法律法规为前提,以扩大土地权能为基础,以征地制度改革为突破,以转变政府职能为支点,发挥市场的资源配置作用,从而构建城乡统一的建设用地市场体系。
The marketization of rural collective construction land is an internal demand of developing socialist market economy. Since the late 1990' s, the marketization of rural collective construction land in China has successively experienced three stages, namely gestation, attempt and starting. With the further development of economic society, it has become objective demands and practical choices to break through the limitations of the existing laws and regulations, to overcome obstacles of systems and institutions and to promote the marketization of rural collective construction land. In the transitional period, the realization of the marketization of rural collective construction land needs both market allocation of resources and macro-control of government. In order to play a role of market allocation of resources, we should improve laws and regulations as a premise, expand land rights as a foundation, reform land expropriation system as a breakthrough and transform government functions as a fulcrum. In this way, a unified urban and rural construction land market system will be constructed.
