Construction of Sports Norms System——Academic Interview of Professor Liu Zuoxiang

体育规范体系由法律规范体系、国家政策体系、政党规范体系和政策、社会规范体系四大体系构成。在体育规范适用过程中,体育自治和国家司法干预是一个非常重要的问题。保留司法和仲裁两个途径,有益于体育纠纷的解决。体育自治是有限的,国家司法介入可以更好地保护体育自治。体育自治规则之间同样存在效力位阶,不应该相互冲突,这要结合具体的运动项目和类型来做判断。为了应对体育自治规则全球化进程,中国应该大力培养熟悉国际体育规则的法律人才,并加入到国际规则制定中去。体育规范体系纳入了有关体育问题的所有规范,与原有的体育法体系或体育行业法体系相比,更具有开放性与包容性。

Sport Norms System consists of four major systems： Legal Norms System, National Policy System, the Party Norms System and Policies, Social Norms System. It is Sport Autonomy and National Judicial Intervention that plays an important role in the application of Sport Norms. It is helpful to solve sport disputes by keeping the two solutions judicature and arbitration. Sport Autonomy is limited and the National Judicial Intervention can give better protection to it. The effect ranks exist between the rules of Sport Autonomy which should not conflict with each other. It should be judged by the specific sport events. In response to the globalization of Sport Autonomy rules, China should vigorously cultivate sports--law experts who are familiar with international ones and try its best to become a member of international rules--making groups. All kinds of sport issues are included in the system of Sport Norms, which is opener and more inclusive than the previous System of Sport Law or Sport Field Law.
