一起伪劣农药“吡效隆”造成西瓜损失的司法鉴定案例分析

A Case Study on the Agricultural Judicial Identification of the Losses of Watermelon Caused by One Kind of Fake and Inferior Pesticides Named Forchlorfenuron

该文分析了一起因生产销售伪劣农药"吡效隆"导致农户种植西瓜产生损失的案件。嫌疑人凌某将"吡效隆"通过代理商销售给瓜农,瓜农使用该农药导致西瓜坐果率降低,产量损失严重。通过书证审查和田间试验调查等方法,认定农民的经济损失与使用"吡效隆"农药有因果关系,并用科学的方法估算出农民的经济损失。鉴定意见质证后被法院采信。

A case was analyzed on the yield loss of watermelon caused by one kind of fake and inferior pesticidesnamed forchlorfenuron,which was sold to growers by a suspect that＇s family named Ling. After using the pesticide,result the decrease of watermelon fruit setting rate,which could cause serious yield lost. Through the written evi-dence review,on-site inspection and laboratory determination methods,it was found that the economic loss of water-melon was caused by using forchlorfenuron. Meanwhile,the farmers＇ economic losses were estimated by using scien-tific methods. And the expert opinion was accepted after cross-examination by the court.
