摘要
TPP知识产权谈判是一个动态博弈过程。借助博弈中"决策人"优势,通过提出严厉的知识产权保护谈判草案,体现了美国在商标、版权、专利和执法等方面的核心利益诉求。针对不同议题,时而联合其他国家共同扮演"决策人"角色;时而利用唯一"决策人"的优势,或未雨绸缪,或采取决不妥协的策略,或针对不同谈判议题采取分而治之策略。尽管各成员方经济社会发展水平存在多样性,借助于有效的谈判策略,知识产权保护谈判已取得了实质性进展。
The TPP intellectual property negotiation is a process of dynamic game. With the help of a game "decision-maker" advan- tage, the United States calls for the core interests in the trademarks, Copyrights, patents, and law enforcement, etc by putting forward strict negotiation drafts of the intellectual property rights protection. For different issues, it sometimes cooperates with other countries to play "decision-maker" role together, sometimes takes advantage of the only "decision-maker" , or saves for a rainy day, or takes no compromise strategy, or takes divide and conquer strategy for different negotiation topics. Though economic and social development a- mong members are diverse, with the aid of effective negotiation strategy, substantial progress has been made in the negotiations of intel- lectual property rights protection.
