基于扎根理论的建设工程合同公平性分析

Analysis on Fairness of Construction Project Contract Based on Grounded Theory

从公平关切视角出发,对四个典型项目的合同采用扎根理论进行合同条款编码,得到建设工程合同公平性构成的三个主范畴,即分配、程序、互动,其符合公平理论的三个维度,进一步构建三个维度下的构成模型。该模型可为发承包双方提供合同公平性审查的指导,而且为后续相关研究提供理论贡献。

From the perspective of fairness concerns, the paper codes the contract terms of four typical projects by the grounded theory, obtains three main categories for fairness of construction project contract, namely distribution, procedure, interaction, consistent with the three dimensions of equity theory. Then, builds the structure model of fairness of construction project contract. This model can provide guidance for the review of the contract fairness of the contracting parties, also provide theoretical guidance for the follow-up related research.
