摘要
随着网络购物的兴起,各类纠纷也层出不穷,湖南"网购自取"纠纷便是典型一例。在民商事纠纷的处理中及时嵌入"习惯思维",尊重"习惯做法",用"习惯"来规范行为模式,在发生纠纷时借助"习惯"的力量来发现规则,同时给予裁判者可供借鉴的参考标准,这都是"习惯"在处理纠纷时能够发挥的作用。与此同时,还需要辨析"交易习惯"的发展与运用,做到嵌入"习惯"适当适时,使其在解决纠纷时能够最大限度地发挥积极作用。
With the rise of online shopping, all kinds of disputes are emerging as an endless stream. The dispute of "The Online Shopping Self-Pick Up" in Hunan is a typical example. When dealing with civil and commercial disputes, we need to timely embed the "habitual thoughts" and respect the "customary practices", as to regulate behavior patterns. In disputes, we should discover the rules with the "habits" while giving the referee the reference standard, in which, the "habits" can play the important role in dealing with disputes. At the same time, we also need to analyze the development and use of "trading habits", and use the "habits" properly and timely so that it can play a positive role in resolving the disputes to the greatest extent.
