美国规制校园欺凌的三维体系及其组件 被引量:14

Three — Dimensional System and its Components of Regulating Bully Behavior in US School

摘要 当前我国的校园欺凌事件层出不穷,亟需出台相关的法律法规进行规制与遏制。美国规范校园欺凌事件的法律机制已经相当完善,且取得了明显的实效。美国从国家、州到学校都拥有结构完整的法律法规或政策文件,形成了一套完整的制度保障。鉴于美国关于校园欺凌的法律规制,我国治理校园欺凌亟需明确校园欺凌的法律定义、制定反校园欺凌的法律体系、完善学校有关校园欺凌的规定。 Currently, bullying incident occurs often in some China's schools , which need introduction of relevant laws and regulations to deal with and curbing the problems. US's legal mechanism of regulating bullying incident has been quite good and have achieved remarkable results. The nation, states and schools all have the structural integrity laws, regulations or policy documents to form a complete system of protection. In view of the United States' legal regulation of student bullying, China' s governance of bullying need a clear legal definition of bullying, developing an anti-bullying legal system and improving the provisions relating to school bullying.
