论知识产权纠纷之起源及其“不诉之课”(ADR机制)——与“一带一路”战略全面接轨

随着"一带一路"战略的实施,陆上丝绸之路重获新生,海上丝绸之路迅速崛起。要想实现"一带一路"的宏伟目标,迅速带动经济发展,必须高度重视知识产权问题。从知识产权原理的视角探讨了知识产权的本质,反思知识产权的价值观念,探索知识产权纠纷的起源,明确知识产权法定主义的内涵,梳理知识产权诉讼的缺陷,说明诉讼并非唯一且最优的解纷路径,还可以通过替代性解决机制(ADR)来进行处理,这样才可以更好地和"一带一路"战略全面接轨。

With the implementation of ＂The Belt and Road initiative,the Land Silk Road is back to life,and the Maritime Silk Road is on the rapid rise.To achieve the grand goal of ＂The Belt and Road＂ initiative and rapidly drive economic development,the issue of intellectual property rights must be attached great importance to.This article explores the nature of intellectual property rights from the perspective of the principle of intellectual property rights,reflects the values of intellectual property rights,probes into the origins of intellectual property disputes,makes clear the connotation of the legal doctrine of intellectual property rights,and sorts out the defects of intellectual property litigation.It explains that litigation is not the only and the best way to resolve disputes and that alternative dispute resolution（ADR） can be used in settling disputes so as to be fully in line with ＂The Belt and Road＂ initiative.
