土地信托流转中的农民权益保障

PROTECTION OF FARMERS'RIGHTS AND INTERESTS IN THE TRANSFER OF LAND TRUST

土地信托作为农村土地承包经营权流转的一种重要的创新模式,比传统的农地流转具有一定的优越性。但由于目前土地信托流转的理论与实践处于初步阶段,对以农民为代表的众多土地承包经营权人的利益保护不完善,导致农民的自主权、知情权受到侵害。建议通过制订《土地信托流转条例》、完善土地信托合同的内容及完善政府对土地信托的监管制度等,以保障农民的权益。

Land trust,as a kind of important innovation mode of rural land contractual management rights transfer,has some advantages over the traditional rural land transfer mode.However,since the theory and practice of land trust circulation is in the initial stage at present,the protection of the interests of the those represented by fanners with land contract and management rights is imperfect,as a result,their rights to make their own decisions and to learn the truth have been infringed.The paper suggests that the land trust circulation regulations be formulated,the contents of the land trust contract be improved,and the government＇s regulatory system for land trust be perfected in order to protect the rights and interests of farmers.
