摘要
香港雇主清盘或破产时的雇员权利保障机制设计十分精良。在香港破产机制中,《破产条例》(香港法令第6章)和《公司(清盘及杂项条文)条例》(香港法令第32章)作为基本的法律框架,以优先权的方式保障雇员权利。香港公司清盘或个人破产时的雇员权利,更多仰赖于破产欠薪保障基金而保障。香港《破产条例》和《公司条例》中的雇员优先权的制度设计及香港破产欠薪保障基金制度设计,对于中国构建破产欠薪保障机制,具有重要参考价值。
The interests of employees in Hong Kong during the insolvency of their employer are guaranteed by the priority position in the creditor's rankings under the Bankruptcy Ordinance(Cap.6) and Companies(Winding Up and Miscellaneous Provisions)Ordinance(Cap.32).Furthermore,the Protection of Wages on Insolvency Fund plays a dominant role in the protection of employee's outstanding payments during the bankruptcy or winding up of their employer.
