论领域法学:一种立足新兴交叉领域的法学研究范式

The Theory of Field Law—— One kind of legal research paradigm based on emerging crossed areas

当今中国,重大领域的社会经济问题愈加呈现出交叉性、整合性和动态性特征,法学学科系统分工精细化与法律现象复杂化之间的矛盾愈加凸显,以问题为中心的整合性、多维度和一体化的研究范式愈加获得重视。在全面深化改革和全面推进依法治国的语境下,有必要确立"领域法学"的概念、以及"领域法"的治理逻辑,以回应社会大变革时代的现实诉求。领域法学,是以问题为导向,以特定经济社会领域全部与法律有关的现象为研究对象,融经济学、政治学和社会学等多种研究范式于一体的整合性、交叉性、开放性、应用性和协同性的新型法学理论体系、学科体系和话语体系;它是新兴、交叉领域"诸法合一"的有机结合,与传统部门法学同构而又互补。这在客观上解决了新兴学科和交叉学科的理论定位和学术归宿问题,是构建中国特色新型现代法学研究体系的理论创新。

In present-day China, social and economic problems in major areas increasingly showing a crossed, collective and dynamic features. Contradictions between the elaborate division in law discipline system and the eomplexification of legal phenomenon are increasingly prominent. Problem-centered integrated, multi-dimensional and incorporative research paradigm are getting increasingly more attention. Under the background of comprehensively deepening reform and comprehensively implementing the rule of law, it is necessary to establish the concept of ＂field of law＂ and the governance logic of ＂ the field laws＂ in response to the realistic demands of the era of great social change. Field of law is a problem-oriented integrated, crossed, open, practical and cooperative new legal theoretical system, discipline system and discourse system, which takes all law-related phenomena in specific economic and social fields as research subjects and integrate multiple research paradigm such as economics, political science and sociology in one simultaneously . It is an organic combination of ＂ all laws unite in one＂ in emerging, crossed areas, which complements and mutually constructs traditional department of law. This objectively solves the problem of theoretical localization and academic pedigree of emerging disciplines and interdisciplinary. It is a theoretical innovation of building a new modern legal research system with Chinese characteristics.
