当前公民网络监督正借助微博广泛地开展,既需要鼓励也需要规范。现有的微博实名制与公民监督权之间存在摩擦,体现在超越了公民监督权的宪理框架,同时也弱化和影响了公民监督权的表达基础与制度基石。在当前贯彻网络实名制的大背景下,完全弃用微博实名制并不现实,因此应致力于修补微博实名制的不足,将完善法律监管和提振制度创新结合起来,推动公民微博网络监督的进一步发展。
