A Study on the Approval of Unsigned Third-partyin Acknowledgement and Implementation of Arbitration Award

随着提交仲裁的争议种类越来越复杂,产生未签字方问题的案件数量也呈上升趋势,仲裁庭或法院解决该问题的关键,在于确定国际仲裁中"同意"所处的地位。法国判例法遵循的是实用主义和自由主义的办法,"同意"只是评估整个案件主客观事实的一个因素。而英国法认为仲裁仍然是一个解决争议的民间制度,同意应是一个主要的专门规则。

With the complexity of controversies disputed to arbitration,cases concerned with unsigned third- party are in rising trend. The key for arbitral court or court to solve the problem is to determine the status of approval in international arbitration. Judge- made law of France abides by pragmatism and liberalism,therefore approval is merely a factor to assess the subjective and objective facts of a case. Whereas,British law considers arbitration as nongovernmental system to solve disputes,thus approval should be a principal special rule.
