专利审查高速路的运行特征、影响及其策略--基于中国本土化的视角

Operation Characteristic,Influence and Strategy for Patent Prosecution Highway: Localization of China

[目的/意义]自2011年加入专利审查高速路以来,该制度经历了怎样的发展历程是我国提出专利审查合作发展策略所面临的关键问题。为了解并掌握专利审查国际协作在我国的运行情况,制定合理的知识产权管理策略,实现合作共赢,对专利审查高速路在中国运行的特点和影响进行研究。[方法/过程]通过数据的实证分析专利审查高速路在中国的运行特征,进而探讨其对中国专利审查工作的影响。[结果/结论]提出改善工作效率、有选择性的开展多边合作、试点共同审批、构建利益均衡的审查合作体系,研究成果有利于完善中国在专利审查国际合作趋势中的策略。

[ Purpose/Significance] China joined the Patent Prosecution Highway （PPH） in 2011, understanding its development after-wards is a key problem for China to make her decision for patent prosecution cooperation strategy. To understand and master the situationof international collaboration of patent prosecution in China, the characteristics and influence of PPH are researched in this paper to facili-tate the efforts in finding reasonable management strategy for intellectual property management and achieving ideal cooperation. [ Method/Process] The characteristics of PPH are analyzed through an empirical analysis, and the influence of PPH on the patent examination workin China is discussed. [ Result/Conclusion ] The suggestions concerning the strategies for better international patent prosecution cooperationinclude improving work efficiency, practicing selective multilateral cooperation, piloting joint prosecution and constructing balanced inter-est patent prosecution cooperation.
