Philosophical Characteristics of Number Influence on the Development of Law

由于理性能力的基础和核心就是计算,因此现代法律的形式合理性立基于数字、数学和逻辑思维体系之上,数字的哲学特性深刻影响着近现代法律的发展。主要体现在四个方面,其一,对数字科学性的认识是法律科学化的起点;其二,数字的确定性对实现法律的确定性作用巨大;其三,数字的简单性对法哲学基本范畴的影响;其四,数字的客观性影响法学思维方式的转变。

Since the foundation and core of rational ability is calculation, so the form of the modern legal rationality founded on numbers, mathematics and logical thinking system, and philosophical characteristics of the number also impact on the development of law. It＇ s mainly reflected in four aspects. First, cognition of scicntificity of number is the starting point of law seientization. Second, certainty of number is the role to realize certainty of law. Third, the sim- plicity of number influences on the basic category of law philosophy; Fourth, the objectivity of number affects the change the mode of law thinking.
