山西矿山环境生态恢复治理问题研究

On the Ecological Restoration Management of Mine Environment in Shanxi Province

山西矿山环境生态恢复治理多年,尽管效果显著但仍问题诸多。文章首先剖析了恢复治理中存在的诸如缺乏法律保障,治理依据位阶低、效力弱;废弃矿山治理资金缺口大,治理效果差等五大问题。依此基础,提出健全法律体系,明确责任主体;建立废弃矿山环境生态恢复治理专项制度;贯彻煤炭资源税改革,煤企履行治理义务;严格准入、理顺体制,创新监管模式;提高治理技术,建立与经济利益挂钩的验收制度等有针对性的建议。

It has taken many years for the government of Shanxi province to try hard in the ecological restoration management of mine environment. Despite the remarkable achievements,there have been still a lot of problems in existence. The article first made an analysis about five major existing problems in the recovery of governance,such as lack of legal protection,low level of governance,weak effectiveness,and great shortage of capital for the governance of abandoned mine,poor governance effect. Based on this,some suggestions are proposed,which involve improving the legal system and clarifying the subject of responsibility,establishing a special system for the ecological restoration and governance of the environment of abandoned mines,implementing the reform of coal resource tax and encouraging the coal enterprises to fulfill their obligations of governance,standardizing the access,rationalizing the system,and innovating the supervision model,while advancing governance technology,and establishing an acceptance system linking with economic interests.
