论干细胞捐献者悔捐权与受捐者生命健康权的冲突与平衡

造血干细胞受捐者的生命健康权在实务中因捐献者的悔捐权而屡屡受到侵害。受捐者生命健康权保护的正当性与捐献者悔捐权存在的合理性使其成为了一对不可调和的矛盾。平衡二者的权利冲突一方面应当对捐献者悔捐权进行一定程度的限制,另一方面需要发挥法律在社会关系中的调控作用,即制定激励法鼓励捐献者积极的进行捐献。造血干细胞捐献激励法必须以捐献自愿为前提,以物质补偿为基础,以精神激励为补充,以社会优待为重点及相应的配套制度作保障,以减少捐献者悔捐现象的出现,实现捐献者悔捐权和受捐者的生命健康权平衡。
