辅助性原则的宪法价值及其在行政给付中的运用

Constitutional value of Subsidiarity Principle and Its Application in Administrative Supply

现代国家职能发生转化的标志之一就是行政给付地位的提升。因其维护社会公平正义的功能,在法律上被确认为我国政府的主要职能之一。我国也提出了建设服务型政府的计划,反映了国家角色的悄然转变。政府不仅是管理者,更是服务者,更多地承担起公民生存照料的义务。辅助性原则的内涵与宪法价值存在诸多共同点,国家辅助性原则在行政给付制度中的适用多有体现,辅助性原则应当成为支配我国行政给付实践的基本原则。

One sign of the transformation of the modern state function is the raised position of the administrative supply which,for its function to safeguard the social fairness and justice,is recognized as one of the main functions of the Chinese government. China also plans to build a service-oriented government,and has proved a steady transformation of the national role. The government should not only be administrators,but also should be the servants and bear more obligations to take care of the citizens＇ life. Many common factors exist between the connotation of the principle of subsidiarity and constitutional value,and the national subsidiary principle has much reflected in the application of system of administrative supply,so this principle should become the basic principle to dominate our government in practicing the administrative supply.
