饮用水源保护区法律制度完善研究——以辽宁省大伙房水库为例

Research on the Development of Legal System of Drinking Water in Water Source Protection Area:Taking Dahuofang Reservoir for Example

饮用水源安全关乎居民身体健康和国家长治久安,饮用水源保护区水源保护与污染防治离不开法律规章制度的完善。现有饮用水源保护区法律制度在实施过程中在法律制定、管理体制、保障制度和法律责任层面仍存在不足。本文以辽宁省大伙房饮用水源保护区为例,提出饮用水源保护区专项法律制定、跨流域管理机构设置、生态补偿机制完善、引导公众参与、行政责任问责机制建立等措施,以完善饮用水源保护区法律制度。

Security of drinking water is related to the residents＇ health and national security. Conserva- tion and pollution prevention and control of drinking water in water source protection area cannot be executed without the improvement of the legal rules and regulations. It is still insufficient in the implementation of the legal system of drinking water source reserves in laws, management system, security system and legal liability level. Taking Dahuofang reservoir for example, we suggest that we should make a basic law of drinking water source reserves, set out inter-basin administrative agencies, improve the ecological compensation mechanism, guide the public participation and establish accountability mechanism of administrative responsibility to perfect the legal system of drinking water source reserves.
