摘要
案例教学法是在解释某一法学理论或法律规范时,采取结合较为典型司法判例加以剖析,来加强学生对相关法学理论及法律规范认识理解的教学方法。它被广泛运用于法学课堂教学中。笔者在《案例刑法学》课程的教学过程中,总结出适合运用到课堂教学中的刑法案例的选取标准,从案例展示、学生讨论、总结点评等阶段揭示出刑法教学案例的每一个运用阶段的特征及其内容,并分别通过组织师生互动、教师对抗、模拟实训等具体模式来探索和实践案例教学法在刑法学教学中的运用。
Case study method is a teaching method to strengthen the students' understanding of the relevant legal theory and legal norms by analyzing the typical judicial cases in the interpretation of a legal theory or legal norms. It is widely used in the teaching of law. In the actual teaching process,the author concludes the selection criterion of the criminal law case suitable to be applied to the teaching,reveals the characteristics and contents of each case in Criminal Law teaching from case demonstration,discussion and summary. And explores the application of case study teaching method in Criminal Law course by teacher-student interaction,teacher confrontation and simulated training.
