中国法制史研究中几个问题——以黄宗智两部专著的观点为例

Reflections on Issues in the Studies of Chinese Legal History——With Viewpoints from Works by Huang Zongzhi as Examples

在传统法制史研究中,往往将中国法制史研究置于一种与现代法制研究完全对立的状态,认为法制史研究仅仅是研究过去的事情,在这种观点指引下的法制史研究,往往与现代法制研究完全脱节。在这种研究理念指引下,导致法制史研究处于一种非常尴尬的式微状态。如何转变法制史研究的传统观念,将法制史研究与现代法制研究相结合,借鉴现代法制研究理念、研究方法,对传统法制史进行研究是现阶段法制史研究亟需解决的问题。

Studies of traditional Chinese legal history incline to put Chinese legal history in a position totally opposite to studies of modern law,deeming that legal history studies center only around things in history.Legal history studies under such viewpoints are often divorced from modern legal studies. What＇s more,this orientation also brings legal history studies into an embarrassing decline. Issues concerning legal history studies that need urgent handling at present are as follows： how to change the traditional viewpoints on legal history studies; how to integrate the study of legal history with that of modern law; how to approach traditional legal history studies by applying modern theories of legal study and methodology.
