Analysis of Application of Division Principle in the Trial of Mining Disputing Cases

矿业领域是国民经济的重要组成部分,而矿业权作为矿产资源的开发利用之方式,其交易的市场化对矿业领域的安全、秩序和效率都有重要作用。因此,在矿业权出让与流转交易中,必须坚持区分原则。本文以最高人民法院审理的矿业案件为例,考察和分析目前矿业权领域司法实践中负担行为与处分行为区分的运用情况,并指出其中缺憾之处,供参考。

Mining sector is an important part of national economy. As one way of exploiting and utilizing mineral resources, mining rights＇ marketization plays a significant role in security, order and efficiency of mining sector Therefore, we must insist on the division principle in transferring and transition transactions of the mining rights. This paper takes the Supreme People＇s Court cases of disputes over the mining rights as examples to analyze the current situation of the application of the division theory on act of liability andact of disposition in judicial practice, and indicates the imperfections for reference.
