摘要
"加百利"轮救助案,经广州海事法院一审、广东省高级人民法院二审、最高人民法院再审做出判决后,在航运界以及海商法界引起了强烈反响。该案涉及的一些海商法问题值得深入研究。特别是,如果该案争诉的合同被认定为所谓的雇佣救助合同,该合同还是不是一种救助合同?有关该合同的争议事项是否属于中国加入的《1989年国际救助公约》的所辖事项并应适用该公约的规定?该合同争议事项是否应受《中华人民共和国海商法》的调整?该文将就这些问题进行讨论并给出观点。
The"Archangelos Gabrie"salvage case,after the trials of the first instance by Guangzhou Maritime Court and the second instance by the People's High Court of Guangdong province,and the judgment of retrial by the Supreme People's Court,has given rise to intense responding in the shipping industry as well as the maritime law circles. A number of maritime law issues involved in this case are calling for further studies and consideration. In particular,when the contract in dispute in this case is qualified as a so-called employed salvage contract,whether or not the contract is still a kind of salvage contract?Whether or not the disputed issues under this contract are within the matters dealt with by the International Convention on Salvage 1989,to which China is a contracting state? Whether or not the disputed issues under this contract should be subject to the provisions of the Maritime Code of the PRC? This paper will discuss these issues and will provide the author's views on the related issues.
