The trend,reflection and prospects of liability insurance of preservation in maritime litigation

针对诉讼保全责任险在其融入海事诉讼实务过程中面临的诸多质疑,以实证主义思维模式,在海事诉讼特别程序视角下对诉讼保全责任险进行了全面地审视与剖析,对海事诉讼领域引入诉讼保全责任险的必要性、可行性进行了重新论证,并对业务办理过程中的信息化建设、保单保函、保险责任、保险金额以及保险期间等问题提出了多项完善建议,以期对中国进一步施行与完善海事诉讼保全责任保险制度提供参考。

Aiming at some doubts concerning the integration of liability insurance of preservation into the practice of marine litigation,this paper,with positive appoach in mind,studies comprehensively on liability insurance of preservation from the perspective of the special procedure of marine litigation,demonstrates the necessity and feasibility of such insurance in the field of marine litigation,and puts forward some suggestions on information construction,policy guarantee,insurance liability,insured amount,liability period and so on,so as to provide reference for further implementation and improvement of the system of liability insurance of preservation in marine litigation.
