Conflicts and Reconciliations between Right and Power: The Problem Domain and Development of Fichte's philosophy of Right

个人权利与国家权力的冲突与和解是构建法治社会的根本性问题,诸多的社会矛盾均能在其中找到根源。但是,在种种口号式的喧嚣中,却鲜有人对二者的关系进行系统的学理论证。费希特的法权哲学正是在这一独特的问题域内展开,从先验的自我出发,不仅推演和论证了个人权利与国家权力合法性根源,并且为二者划定了各自的界域。

The conflicts and reconciliation of the right and power is the fundamental problem of rule of law. Many social issues are rooted in them. However, there are more slogans but less deeply theoretical anatomy on this issue.Fichte＇s philosophy of right was focused on this unique problem domain. Starting from the transcendental ego, not only deduced the legitimacy of the right and power, but established the different boundaries according to different aims and needs of individuals and states.
