摘要
我国职工持股会在运行组织形态及治理机制层面上的法律属性设计,应以增进实现职工利益、企业利益及国家利益为基本取向。以此为指引,结合信托制度的特性,从现实性与优越性角度考量,我国职工持股会在立法层面宜采取信托制的运行组织形式。
The executive morphology and the management sys- tem of ESOP Association System should be based on promot- ing the interests of employees enterprises and the country. On this basis, combined with the characteristics of the trust sys- tem, from the perspective of reality and superiority, at the legislative level, ESOP Association System of our country should take the form of Trust System.
