商品房买卖中“霸王条款”的原因探讨与反思

摘要 霸王条款在我国市场消费领域普遍存在,尤其在垄断行业更为盛行,比如房地产市场中的霸王条款即为一种典型,严重损害了购房者的利益,也扰乱了房地产市场的秩序。文章以房地产领域中频发的霸王条款为视角,通过典型案例的引入和总结,深刻剖析现象存在的原因,并提出有针对性的解决措施,提高对消费者权益的保护,也对司法实践有一定的参考意义。 High-handed Clause is universal in the consumer market in China, and it is especially prevalent in the monopoly industry. For example, High-handed Clause in the real estate market is a typical one, which not only seriously damages the interests of property buyers, but also disrupts the order of the real estate market. From the perspective of High-handed Clause in the real estate field, and by introducing and summarizing the typical cases, this paper analyzes profoundly the reasons for the existence of such phenomenon. And finally it puts forward measures to enhance the protection of consumer rights and interests, which also bears a certain reference significance to the judicial practice.
