环境侵权行为具有社会妥当性、间接性、公害性等诸多特性,致使传统侵权责任法在面对环境污染案件时常常功能失灵,捉襟见肘。为了突破困境,传统侵权责任法转型向社会化的方向发展,环境污染责任保险应运而生,并对侵权责任法产生了深刻的影响。以侵权责任法为环境污染责任保险制度的适用基础,以环境污染责任保险制度为侵权责任法的实施补充,侵权责任法与环境污染责任保险制度相互影响、相辅相成,共同构成了环境侵权的救济体系。

In order to break through the difficulties, traditional tort liability law began to transform and develop in the direction of socialization, so environmental pollution liability insurance came into being, and had a profound impact on tort liability law. Environmental pollution liability insurance system is the basis of tort liability law, tort liability law is a supplement to the liability insurance system of environm-ental pollution, tort liability law and environmental pollution liability insurance system affect each other and complement each other, together constitute the relief system of environmental tort.
