摘要
互联网环境下电子游戏大行其道,游戏玩家在享受游戏乐趣的同时希望从游戏中获得更佳的娱乐效果,即在游戏本体上增加一些新元素制作成游戏MOD。然而游戏MOD的制作却带来一些著作权方面的纠纷,从认定游戏MOD是否侵权到如何规制游戏MOD的制作、发布都是亟待解决的难题。制作游戏MOD属于一种再创作行为,要获得原著作权人许可,通过默示许可的商业模式可以解决授权问题,同时游戏因各种MOD也会延长生命周期。
Video games are in their heyday under the Internet environment.While enjoying the games,the players want to be better entertained,which calls for the creation of game MOD by adding new elements to the games.However,the creation of game MOD may involve some copyright disputes,such as game MOD copyright infringement judgment and the regulation methods of the production and distribution of game MOD.Game MOD creation is a kind of re-creation behavior and needs the license of the original copyright owners.Implied license can be a good option in solving the licensing problems.The games can also prolong their life circle thanks to various MOD.
