执行异议之诉作为一种新型诉讼,体现了我国司法理念的更新与司法制度的进步。该种诉讼形式刚刚起步,还尚显稚嫩,特别是在程序设计上还有许多不足,造成了司法实践中的很多问题难以妥善解决。需要立足于执行异议之诉案件的性质与特点,从程序和实体两个方面对执行异议之诉中存在的理论和实践问题予以总结,从而提出相应的解决方案。

As a new kind of litigation,the implementation objection reflects the renewal of the idea of our country and the progress of the judicial system. This kind of lawsuit has just started,and is still not mature,especially in program design; there are many problems,which has caused many problems difficult to resolve in the judicial practice. We need to propose the corresponding solutions basing on the nature and characteristics of the implementation objection,summarize the theoretical and practical issues of the implementation complaint from both the procedural and substantive aspects.
