国际建筑工程施工合同条件在我国的适用问题研究

以FIDIC、JCT、NEC为代表的国际建筑工程合同条件，经过历次修订，已形成一套完备、规范的国际工程管理模式，对国际建筑业实践需求发挥着不可替代的作用。在我国建筑服务市场遭遇国际化挑战的环境下，工程承包项目的合同条款必须充分与国际接轨，而如何在我国引入及适用国际合同条件是必须重点研究的课题。我国2013版《建设工程合同范本》对1999版范本的修订充分借鉴了国际惯例，为国际合同条件的适用开辟了新的视角，而我国法律体系的完善也对国际合同条件的国内适用清除了法律障碍。在我国适用国际合同条件不仅必要，而且可行。

Internaitonal conditions of constructional contracts represented by FIDIC, JCT, NEC have undergone revisions for many times, formulating a set of self-contained, normative mode of managing internaitonal engineering, which plays a irreplacable role to meet the practical needs of construction industry. Under the internaitonal challenges towards Chinese constructional markets, the specific terms of engineering contracts should be geared to keep in line with the international markets, as a result, the problem on how to introduce the international conditions of contract have to be studied in detail. The revision of Chinese Model Constructional Contract Text in 2013 drew lessons from international usages, opening a novel perspective for the applicaiton of international conditions in China, the improvement of our legal system have removed impediments for the applicaiton of international conditions, which is not only necessary but also possible.
