我国体育赛事产业的法律保护研究

Research on the Legal Protection of Sports Event Industry in China

体育赛事产业收入主要依赖体育赛事转播权和体育赛事标志的市场开发。分析了体育赛事产业概念及分类,体育赛事产业具有较高的关联性,形成了一个系统且又复杂的产业链,体育赛事产业可细分为5大类。分析了我国体育赛事转播权和体育赛事标志的立法、执法、司法的保护现状及问题,我国体育赛事产业存在体育赛事标志立法强于体育赛事转播权立法;对奥林匹克标志保护执法强度远高于一般赛事标志执法力度;法院对体育赛事转播权和体育赛事节目司法判决案例中,由于对体育赛事转播权法律性质界定不清晰,判决结果存在很大差异。我国体育赛事产业主要存在立法层次低,缺乏体系性;缺乏责任追究与侵权救济制度;投融资法律保障机制不完善;缺乏行业自律;执法机关打击力度不强等问题。借鉴分析了美国体育赛事产业在赛事标志、税收、体育赛事转播法案、版权法、网络转播等方面的保护经验。最后提出了完善体育赛事产业立法,提高行政执法的执行力,完善体育赛事产业投融资政策,加强体育赛事产业的行业自律,严厉打击各类体育赛事侵权行为等保护措施。

The sporting event industry revenue mainly depends on the market development of sports broadcasting right and sports event mark.This article analyzed the concept and classification of the sport event industry.The study suggests that the sporting event industry has a high correlation,forming a system and complex industrial chain,and the sports event can be divided into five major categories.analyzed the legislation,enforcement,judicial protection status and problems of sports events broadcasting rights and sports events.The present situation of the legal protection of the sporting event industry in China includes the following aspects：the sports event marking legislation is stronger than the sports broadcasting rights legislation;the law enforcement intensity of the protection of the Olympic mark is much higher than the general competition mark law enforcement;Although some court cases related to the judicial decision on the sports events broadcast rights and sports events appeared,due to the nature of sports broadcasting rights law does not define clearly,there is a big difference in the verdict,and so forth.Besides,there are still some problems in China＇s sporting event industry,low-level legislation and the lack of systemic;lack of accountability and tort relief system;investment and financing mechanisms are inadequate legal protection;the lack of industry self-regulation;law enforcement agencies to combat is not strong,etc.This article draw on the analysis of the sporting event industry in the protection of the US experience in the event marks,taxation,sports broadcasting right bill,copyright law,broadcasting network and other related aspects,and finally put forward several safeguard measures of perfecting sports industry legislation,improving implementation capacity of administrative law enforcement,improving the sports industry investment and financing policy,strengthening the self-discipline of industry of sports events industry,severely attacking all kinds of sports event infringement act etc.
