中日两国社区矫正制度建设比较研究

A Comparative Study of Community Correction System Construction between China and Japan

社区矫正不仅是刑罚制度文明和进步的表现,也是世界刑罚制度改革的基本走势,通过比较研究的方法,从社区矫正的历史沿革、界定及组织架构三个层面分析中日两国社区矫正的异同,研究历史演变背后的法律政策要素、刑罚执行与社会保护的关系,界定涵盖的射程范围、组织构架的功能与效果,以及调动民间力量参与社区矫正的社会价值。提出建立和推动中国社区矫正的法律制度,上移和简化现有组织架构,扩大社区矫正的射程范围,有效减低司法行政成本,为民间参与社区矫正预留空间等对策建议与思考。

Community corrections is not just a civilized criminal law system and a demonstration of progress,it is also the basic trend of criminal law system reform throughout the world. From the historical evolution of community corrections,this article uses comparative research methods to define and develop a three- tiered framework of analysis on the differences and similarities between China and Japan＇s community corrections. First,it researches the key factors behind the historical evolution of legal policies,and the relationship between criminal law implementation and the preservation of society. Second,the article gives definitions that include the range and scope,as well as the functions and effects of the structural developments. Third,the article reports on the societal value of influence on the power of the masses to participate in community corrections. Additionally,the article gives ideas and thoughts on establishing and promoting community corrections in China＇s legal systems,such as moving up and simplifying current establishments and organizations,expanding the range and scope of community corrections,effectively reducing judicial administration costs,making room in the policies for the participation of the people in community corrections,etc.
