新型律师职业伦理建设的实证探究

An Empirical Study on the Construction of New Lawyers' Professional Ethics

法治国家建设,是我国进行社会主义现代化,实现中国民族伟大复兴中国梦的重要内容。律师作为法律职业共同体的一部分,在法治国家建设中起着不可替代的作用。然而,律师行业的现状却与其承担的责任不相匹配。目前,律师在执业过程中,存在着泄露委托人隐私、律师之间的不正当竞争、对司法工作人员进行贿赂等严重违反律师职业伦理和损害法律形象的事情发生。文章以具体的案例为视角,以实证为研究方法,为解决我国律师职业伦理中存在的问题提供了新的视野。

Establishment of rule of law is an important part of carrying out socialist modern- ization and realizingthe great rejuvenation ofthe Chinese nation. As apart of the legal professional community, lawyers play an irreplaceable role in the construction of the rule of law. However, the state of lawyers does not match its responsibilities. At present, in the course of practice, many problems exist, such as leakageofclient privacy, unfair competitionbetween lawyers, the briberyof thejudicial staffandother serious violations ofthelawyer＇sprofessionalethics. Basedontheconcrete cases and the empirical research methods, this paper provides a new perspective to solve the problems in theprofessional ethics of lawyers in China.
