人"何以违法"的问题,首先应该是社会与文化的问题,而非单单是一个法律规则的问题。需要在法律构成的不同主体之间去理解法律为何,同时也要去借此互动所展开的立法者的逻辑与守法者的武器之间寻求一种对于法律为何的理解。不论是道德意义的"天",还是法律意义的"法",其内涵都是可以不断去进行放大和缩小的。何以违法,向来是要以情境来界定的,此时此地的违法者,到了彼时彼地,可能就是一位守法者。在看待违法的问题上,单单依赖于对个人行为的理解,无法完整地去理解法律本身。法律要有人心作基础,不能完全通过外化的强力去使之彻底的改变,这可能是理解规则跟人心之间关系的一个基本原则,特别是对于现代社会的基于变革的心态而言,这种规则的保护很是急需。

Perhaps it is a basic principle to understand one＇s mind and rules or law, espe- cially in modem society.
